1. AGREEMENT BETWEEN CUSTOMER AND PARAISO TRAVELS COL.
This website is operated by Paraiso Travels Col. RNT 75393. This website is provided solely to assist customers in gathering travel information, determining the availability of travel-related goods and services, making legitimate reservations or otherwise transacting business with travel suppliers, and for no other purposes. The terms we, us, our, and Paraiso Travels Col. The term you refers to the customer visiting the website and/or booking a reservation through us on this website.
This website is offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the ‘Terms of Use’ or ‘Agreement’). Please read the Terms of Use carefully. By accessing or using this website, booking any travel products or services on this website you agree that the Terms of Use then in force shall apply. If you do not agree to the Terms of Use, please do not use or make bookings through this website or our call centre agents. Holiday Tours may at any time change these Terms of Use and your continued use of this website is conditioned upon acceptance of the updated Terms of Use.
The Services offered by Paraiso Travels Col. as defined below can only be used by customers who have first read these General Terms and Conditions and accepted them unconditionally by clicking on the appropriate box provided for the purpose. It is not possible to proceed with the booking process without this acceptance. Customers undertake to fulfil the obligations contained within these terms and conditions. The agreement between Customer and Paraiso Travels Col. comes into force as soon as Paraiso Travels Col. provides written confirmation of a booking to the customer by email.
Customers are deemed to have read, understood and accepted the following, should save and/or print a copy of these terms and conditions for future reference when making a booking.
2. PRICE AND PAYMENTS
The default currency on the website is United States Dollar (USD). Payment through the payment gateway will be processed and charged in USD. Prices in other currencies are indicative and subject to the exchange rate charged by your bank plus any transaction fee determined by the bank or other agency processing the transaction. This means the amount listed on your credit or debit card statement may be a different figure than the figure shown when making your reservations on this website. If you have any questions about these fees or any exchange rate applied to your booking, please contact your bank or credit card issuer.
3. SERVICE FEES
No service fees are charged for self-service bookings made on the website. A service fee of USD 15 per booking will be charged if assistance is required from our support team to make bookings online. If travel planning service might be needed, a consultation fee of USD 50 per booking will be charged. This fee is to compensate for the time taken by our reservations team to research and plan for your travel. Should you proceed with making the reservations with us, the consultation fee will be used as part payment for your reservations with us.
4. BOOKING FEES & FINAL PAYMENT PER PERSON
A reservation will be affected upon receipt of your booking fees and booking/s is/are subject to service/tour availability. The booking fee forms part of your final payment. This booking fee is a standard of USD15 which will be included in your final payment, after your tour/service has been completed will this booking fee will be automatically reimbursed and only in case of cancellation or reschdeule will be deducted and no reimbursed.
This booking fee will cover any operational costs due to cancellations or reschedules.
Balance or full payment must be made 2 days prior departure. Failure to comply with this may result in an automatic cancellation of your reservation and forfeiture of your deposit.
All bookings and purchase shall be made in United States Dollar (USD) based on the exchange rate on date of transaction and foreign currency bookings or purchase shall be converted to USD on the date of the said transaction.
5. CANCELLATION & AMENDMENT
Cancellation and/or amendment to reservations must be made directly with Paraiso Travels Col.
6. CANCELLATION OF TOUR BY COMPANY
The company reserves the right to cancel the tour due to uncontrolled factors that do not allow the conduct of a safe tour or the delivery of services as described in the itinerary, including acts of strike, civil strike, pandemic, endemic and order from the Government of Colombia and/or other countries.
The company shall recommend alternative tours preferably to the same destination or other similar tours to you. Should you decide not to accept the alternative tour, the company shall endeavor to refund all monies paid in full, subject at all times to the company’s partner’s refund policy. The company reserve the right to alter or modify with or without prior notice the itineraries, travel arrangements and hotel accommodation in anyway necessary, or withdraw the services of an accompanying tour manager, due to circumstances over which the operators have no control.
7. CANCELLATION OF TOUR BY PASSENGER
In the event the passenger decides to cancel his/ her tour or travel booking, the booking fee paid by the passenger will be deducted and the left amount paid by the service/tour will be reimbursed to the passenger. E.g., You paid USD100 for a tour and after cancellation you will be reimbursed USD85.
If the customer does not present himself/herself at the departure of the trip, a no-show situation with no previous notice of minimum 6 hrs, the same type of reimbursement as explained above will be applied.
We reserve the right to cancel your booking if payment is deemed to be suspicious by the bank or if full payment is not received in a timely fashion
8. RESCHEDULE/ CHANGE OF BOOKING
If after making the booking the customer wants to change the trip with respect to the date of travel, the destination, the place where the trip starts, the accommodation or the means of transport, the customer should contact the Customer Support Team for assistance.
Bookings can be changed, provided space is available and subject to terms and conditions found at individual services’ guidelines. A change on the entire booking is considered as a cancellation and subject to cancellation policies. You may cancel booking at any time. Cancellations must be made in writing to avoid any misunderstanding. No amendment may be made within 2 working days prior to the date of departure.
No fees are applied by rescheduling or simple changes like durations of the tour, pick up point within Bogotá or pick up hours.
9. REFUNDS / REFUND OF UNUSED SERVICES
In the event of a refund due to cancellation or changes to the booking, refunds will only be due to the customer in line with the rules and restrictions of the applicable suppliers as notified in the booking process.
No refund can be made in respect of accommodation, meals, sightseeing tours, transport or any other services, which are included in the tour fares and not utilised by the tour member.
All refunds shall depend on the exchange rate at the point of refund. Upon receiving the refunds from supplier, the amount (after deductions of booking fee) will be transferred back via the same payment mode of the original booking.
10. NAME IN RESERVATIONS - REASSIGNMENT
Reservations must be booked in the guest’s name as it is displayed on the passport. Name changes are not allowed. The guest will be asked for a any type of ID at the time of pick up. If the name on the reservations and the passenger’s ID do not match, the customer will be required to make a new reservation.
Customers can transfer or assign their booking to another person in any situation, this must be done by the same person who did the first booking, the customer must contact our support team to do so, in written, can be done before the service up to the same time of pick-up. The booking, if transfered, will keep the same conditions, itinerary, price and policies.
11. CONFIRMATIONS
Confirmation of a booking includes the essential elements such as the description of the service booked and the price, which will be sent to the customer by email. If the customer does not receive a confirmation email after 24 hours of placing the booking, he/she should contact the customer support team.
It is expressly agreed that data stored in the information systems of Paraiso Travels Col. and/or its suppliers shall constitute proof with respect to the bookings made by the customer. Data stored in computers or electronic media are valid proof, and shall therefore be acceptable under the same conditions and with the same evidential value as a physical written document.
TRAVEL DOCUMENTS
It is the passengers’ responsibility to ensure their travel documents and necessary visas are in order. The company shall advise you on the documentation required, if needed by the customer.
You must have the necessary visas, vaccinations and health certificates as required by the various Government authorities of the countries to be visited.
The company cannot be held responsible or liable for any expenses, reimbursement, or refund of services/ tour prices if any passenger is refused entry by any country on the tour for whatsoever reasons, including lack of necessary visa or health certificates.
13. ADMINISTRATIVE AND HEALTH REGULATIONS
You are responsible for ensuring that you meet foreign entry requirements and that your travel documents, such as passports and visas (transit, business, tourist, and otherwise), are in order and any other foreign entry requirements are met. Paraiso Travels has no special knowledge regarding foreign entry requirements or travel documents. We urge customers to review travel prohibitions, warnings, announcements, and advisories issued by the relevant governments prior to booking travel to international destinations.
Health: Recommended inoculations for travel may change and you should consult your doctor for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. For medical advice regarding your journey, please contact your doctor.
Disinfection: Countries reserve the right to disinfect vehicles if there is a perceived threat to public health, agriculture or the environment. The World Health Organization have approved the following disinsection procedures: spray the vehicle or cabin with an aerosolized disinfectant while passengers are on board or treat the vehicles’ interior surfaces with a residual disinfectant while passengers are not on board.
For information on visa or health certificates requirements, Customers are advised to contact the embassy of the country they propose to visit.
14. SERVICES RATINGS AND REVIEWS
Star ratings and reviews are a general guide. You should be aware that these are not necessarily the official local rating and that standards can vary between services, tours, hotels and accommodation of the same class in different countries, and even in the same country. Different countries have different standards; a 3-star hotel in one country is not necessarily equivalent to a 3-star hotel in another.
15. SERVICE IMAGES
Whilst we endeavour to ensure that property images and descriptions of services and activities displayed on Paraiso Travels are an accurate and up to date representation of the properties, we cannot guarantee this always to be the case as we obtain this information from our Travel Suppliers. The images and information are provided to give a general ‘feel’ and information for the service.
16. SERVICES AND ACTIVITIES
It is possible that, from time to time particular activities offered by the suppliers that are shown in the description of the tours on the website are cancelled, for example as a result of weather conditions or other reasons beyond the supplier’s reasonable control, during out-of-season stays, or if the required number of participants for the activity is not achieved.
Where sightseeing is concerned, the sequence of the various tourist attractions is shown only as an indication. This can be changed by the suppliers.
17. ACCOMMODATION MEALS
If meals are part of an accommodation package, the number of meals depends on the number of overnight stays. Full board normally includes breakfast. If one or more meals cannot be taken, no refunds will be made.
The customer is reminded that, unless specified otherwise on the website, drinks are not included with meals. If drinking water is not available, the customer will bear the cost of buying it himself/herself.
Parents are advised to bring special food for their baby with them, as this is not always available locally.
18. TAXES
Each activity/service/tour/meal price has already included the taxes that are charged by the goverment of Colombia. This means that at your final payment for the booking made these taxes are already charged and at any situation or time Paraiso Travels Col. will charge extra or beside the final payment that the customer has done previously to proceed with the service booked.
19. COLLECTION/USE OF THE VEHICLE
Drivers must usually be aged between 21 and 65. All drivers must produce a full valid driving license for the category of vehicle used when taking delivery of the vehicle. The driving license must be held for at least one year. Each vehicle complies with the local laws of transit and regulations required by the goverment of Colombia.
20. INSURANCE POLICY
The prices on the website includes insurance policy. The risks covered by these policies, as well as the cost and the amount of cover, are shown on the Paraiso Travels Col’s website only for the purpose of illustration. Claims must be submitted directly to the insurance company in accordance with the terms and conditions of the policy.
21. TOUR INFORMATION & PRICES
Prices shown are correct at the time of publication information and the Price List forms part of the brochure and webpage. The prices are subject to change due to increase in airfares, exchange rates, other transport costs, hotel rates, government tax, etc, and therefore the company reserves the right to increase prices on the website accordingly without notice.
22. RIGHT TO REJECT
The company reserves the right to cancel or withdraw any itinerary, or any bookings made for a client or decline to accept or retain any person as member of a tour. If any such person may appear likely to endanger the health, safety or impair the comfort and enjoyment of others on the tour. The company further reserves the right to cancel this reservation.
If for any other reason, any carrier, hotel or other contractor refuses to allow the participant/participant’s to participate in the tours, the company’s sole liability shall be to refund to the passenger any monies paid less the amounts for the services already utilised, administration, cancellations fees and other deductions in compliance to the partner’s terms and conditions on refund.
23. TRAVEL AGENT LIABILITY
The information, software, products, and services provided through Paraiso Travels Col. may include inaccuracies or typographical errors.
Wholesalers, airlines, hotels and other suppliers providing travel or other services for Paraiso Travels Col. are independent contractors and not agents or employees of Paraiso Travels Col. are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
Paraiso Travels Col. have no liability and will make no refund or compensation in the event of any delay, cancellation, overbooking, strike, force majeure, or other causes beyond their direct control and they have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.
In no event shall Paraiso Travels Col. and/or their respective suppliers be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, the use of the Paraiso Travels Col. or with the delay or inability to use Paraiso Travels Col., or for any information, software, products, and services obtained through Paraiso Travels Col. or otherwise arising out of the user of Paraiso Travels Col. whether based on contract (including fundamental breach), tort, strict liability or otherwise, even if Paraiso Travels Col. and/or their respective suppliers have been advised of the possibility of damages. Because some jurisdictions do not allow the exclusion or limitation of liability for on sequential or incidental damages, the above limitation may not apply to you.
All claims against the company must be made in writing within 30 days after the completion of the tour.
All disputes if any will be subject to the Republic of Colombian Court of Law.
All terms and conditions mentioned above cannot be altered or waived and enquiries pertaining to this document may be made to Paraiso Travels Col. and Travel Legal Department.
The company shall advise and if needed, assist you with regards to any claims against any party in your tour.
Paraiso Travels Col. shall ensure that the collection, use and disclosure of your personal data is consistent with the Personal Data Protection Act 2010 (‘PDPA’). It is acknowledged that personal data collected and processed is obtained voluntarily and with your consent.
